Across-Government Contracts

Ethical Conduct

A person having access to a strategic across government contract is not permitted to allow any unauthorised person to have access to, or divulge to any unauthorised person, the commercial-in-confidence information of these contracts.

Practices such as using the price in strategic across-government contracts as a negotiating point for procurement from:

· unsuccessful tenderers who offer prices lower than their original tender or at the contract price; or
· suppliers who offer prices lower than or at the contract price,

are unethical and are not acceptable.

ACROSS-GOVERNMENT CONTRACTS

Introduction

Strategic across-government contracts are a form of standing offer developed by either the State Procurement Board or an individual portfolio in its role as a lead agency. The objective of these contracts is to achieve strategic outcomes for the public sector through procurement activity and centralise;

· the evaluation of offers to determine technical compliance;
· the negotiation of terms and conditions; and
· contract development.

Centralisation of these processes delivers savings to agencies by reducing transaction costs and reduces the risk associated with repetitive or common purchasing. These contracts are of strategic importance and by aggregating expenditure provide the best result for government in terms of savings, service levels and value for money.
